End User License Agreement

This End User License Agreement ("Agreement") is between you and Hibernyte (Andrea Zani), France ("Hibernyte", "we", "us"). It covers the Launchr application for macOS, its installer, its bundled helpers and any updates we provide (together, "Launchr").
By installing or using Launchr you agree to this Agreement. If you do not agree, do not install or use Launchr. If you use Launchr on behalf of a company, you confirm that you may accept this Agreement for it, and "you" means that company.
1. License
Launchr is licensed to you, not sold. Subject to this Agreement, Hibernyte grants you a personal, non-exclusive, non-transferable, revocable license to install and use Launchr on Macs you own or control, for your own work, including commercial work on your own apps or your clients' apps.
2. Plans and license keys
Launchr has three plans:
- Free: no license key. You can edit one app at a time.
- Trial: a free license key that expires 14 days after it is issued.
- Pro: a paid monthly or yearly subscription, sold through our reseller Polar (polar.sh), with a license key that stays valid while the subscription is active.
A license key belongs to the person it was issued to. You may activate it on up to the number of Macs its plan allows (currently 3). You may not share, sell or publish a license key. When a trial ends, a subscription ends or a key is revoked, Launchr returns to the Free plan; your data stays on your Mac.
Payments, renewals, cancellations and refunds are handled by Polar as the merchant of record, under the terms shown at checkout. You can cancel at any time; Pro stays active until the end of the period you paid for.
3. Restrictions
Except where the law allows it despite this restriction, you may not:
- copy, modify, translate or create derivative works of Launchr;
- reverse engineer, decompile or disassemble Launchr, except to the extent the law that applies to you expressly permits it (for example, to achieve interoperability);
- remove, bypass or interfere with license checks, plan limits or activation limits;
- rent, lease, lend, sell, sublicense or redistribute Launchr, or offer it as a hosted or managed service to third parties;
- remove or alter any copyright, trademark or license notice in Launchr.
These restrictions do not limit any right you have under the open-source licenses described in section 4.
4. Third-party and open-source components
Launchr includes third-party and open-source software, including the App Store Connect CLI (MIT License), SwiftTerm (MIT License) and the Geist typefaces (SIL Open Font License 1.1). Each component is licensed to you under its own license, not under this Agreement. Their notices and license texts are in the NOTICE file and in Launchr under Settings → Updates & about → Open-source licenses. If a component's license conflicts with this Agreement, that license governs that component.
5. Your accounts, agents and data
Launchr acts on your App Store Connect account and other Apple developer services with the credentials you give it. You are responsible for those credentials and for every change made through Launchr, including changes made by coding agents you connect to its MCP server and approve. Apple's terms continue to apply to your developer account.
Launchr stores your data on your Mac. Which network requests it makes, and the anonymous usage analytics it sends unless you turn them off, are described in the Launchr Privacy Policy at launchr.hibernyte.com/privacy.
6. Updates
Launchr checks for updates and can download and install them. Updates may add, change or remove features. This Agreement applies to every update unless an update comes with a new agreement.
7. Ownership
Hibernyte and its licensors own Launchr and all intellectual property rights in it. "Launchr" and "Hibernyte" are our trademarks. This Agreement gives you no rights in our names or logos. Except for the license in section 1 and the open-source licenses in section 4, all rights are reserved.
8. Feedback
If you send us suggestions or feedback, we may use them freely and without any obligation to you.
9. Termination
This Agreement lasts until it ends. It ends automatically if you break it and do not fix the breach within 14 days of notice from us. You may end it at any time by uninstalling Launchr. When it ends, you must stop using Launchr and delete it. Sections 3, 4, 7 and 10 to 13 survive termination.
10. Disclaimer of warranties
To the fullest extent permitted by law, Launchr is provided "as is" and "as available", without warranty of any kind, express or implied, including fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. Hibernyte does not guarantee that Apple will accept any app, build, submission or metadata prepared with Launchr.
If you are a consumer, you keep the statutory rights the law of your country gives you, including the legal guarantee of conformity for digital content in the European Union. Nothing in this Agreement limits those rights.
11. Limitation of liability
To the fullest extent permitted by law, Hibernyte is not liable for any indirect or consequential loss, or for lost profits, revenue, data, business or goodwill, arising from or related to Launchr. Our total liability for all claims under this Agreement is limited to the amount you paid for Launchr in the 12 months before the claim, or EUR 50 if you paid nothing.
These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct.
12. Apple
App Store Connect, Xcode, TestFlight, iOS and macOS are trademarks of Apple Inc. Launchr is not affiliated with, sponsored or endorsed by Apple.
13. Governing law
This Agreement is governed by French law. The courts of France have jurisdiction, except that if you are a consumer you may also bring proceedings in the courts of your country of residence, and you keep the protection of its mandatory consumer laws.
14. Changes
We may update this Agreement. The current version is at launchr.hibernyte.com/eula. Changes apply to updates of Launchr released after the change. If you do not agree to a change, stop using Launchr; any paid Pro period remains available until it ends.
